Article 1 – Purpose

These terms and conditions define the rights and obligations of the buyer regarding the cruises and train journeys sold through Croisières Canada Ltée online catalogue, within the framework of a remote (online) booking system.

Article 2 – Identification of the Offer Provider

The cruise and train travel offers governed by these terms are provided by Croisières Canada Ltée, Montreal based company with a share capital of $CA 5000 registered under number (NEQ) 1180878887, holds a ministerial licence No.703731. Head office A-152-1470 rue Peel Montréal (Québec) H3A1T1 Canada.

Article 3 – Main Features of the Trips

The key features of cruises and train journeys offered through the Croisières Canada Ltée online catalogue are defined as follows. 1. Duration of the Cruise or Trip The duration includes the departure day (starting from airport or port check-in) and the return day (ending upon arrival at the airport or port). Arrival at the embarkation point may occur late in the evening or overnight, and return flights may depart early in the morning. If, due to airline or transport schedules, the first and/or last night is shortened, no refund will be granted. For return flights, passengers must reconfirm their seat no later than 72 hours before departure. 2. Meals For a seven-night stay: Half board includes seven breakfasts and seven main meals. Full board includes seven breakfasts and fourteen main meals. Meals served on the aircraft are counted in these totals. Additional meals are payable locally, and missed meals (for example, due to flight schedules) are non-refundable. 3. Availability All cruises and train journeys listed in the Croisières Canada Ltée online catalogue remain available while supplies last. In case a selected trip is no longer available, the buyer will be notified in accordance with travel sales regulations.

Article 4 – Validity of Offers

Cruise and train travel offers published in Croisières Canada Ltée online catalogue remain valid as long as they are displayed online and until all available spaces are sold out.

Article 5 – Prices

All prices listed in Croisières Canada Ltée online catalogue are shown in euros, including all applicable taxes except airport taxes, which are applied at the time of order confirmation. Prices exclude: Pre-departure services (before airport check-in), Vaccination fees, beverages, gratuities, and any personal expenses. Rates are based on the number of nights rather than full days. Discounts are only applicable when expressly indicated for specific cruises or train journeys. The price guaranteed to the customer is that displayed in the online catalogue on the date of order confirmation (see Article 6). However, prices may vary according to travel period or number of participants. These variations are detailed in the price tables accompanying each itinerary. Croisières Canada Ltée and its technical partners reserve the right to adjust prices at any time, notably due to fluctuations in fuel costs, airline fares, exchange rates, or taxes. Additional modification or cancellation fees may apply, at least equal to those imposed by the transport provider or operator.  Croisières Canada Ltée may also add its own administrative fees.

Article 6 – Acceptance of the Offer

For each cruise or train journey offered, the buyer’s acceptance of the offer is confirmed through a validation click (“Confirm my booking”) within - Croisières Canada Ltée online catalogue, which includes the entry of required personal and payment information, such as: Last name and first name Address (and delivery address if different) Email Telephone number (optional) Payment details (credit card or bank information) Service fees, sometimes referred to by cruise lines as gratuities, onboard service charges, or stay taxes, are mandatory and must be paid at the end of the cruise directly on board. These fees are intended to maintain the highest service standards. The amount varies depending on the cruise line, destination, and cruise duration. Article 7 – Cancellation Policy

Croisières Canada Ltée reserves the right to apply all cancellation or modification fees imposed by the cruise line or airline in the event of: passenger name changes, changes to travel documents, or alterations to cabin occupancy. Airline, hotel, and transfer bookings are 100% non-refundable once issued. Travel insurance, once purchased, is also non-refundable. Below are the standard cancellation penalties, unless otherwise stated by the cruise line:

  • More than 120 days before departure: 10% of the total trip cost (min. CAD 150 per person)
  • 120 to 91 days: 25%
  • 90 to 61 days: 50%
  • 60 to 31 days: 75%
  • Less than 31 days or no-show: 100%

Each cruise line may apply specific cancellation conditions, which take precedence over these general terms.

Article 7 bis – Customer-Initiated Changes

Note: For services including air transport, change fees may amount to the full cost of a round-trip ticket. If a cruise booking is modified, the replacement cruise must be of equal or greater value. If the new booking price is lower than the original, no refund will be issued. If the customer changes the departure date of a cruise, the original departure date will be used to determine the applicable terms for modifications, cancellations, and refunds. Under French consumer law, a customer generally has a seven-day withdrawal period for contracts concluded online. However, certain services—including accommodation, transportation, dining, and leisure services scheduled for a specific date or period—are exempt. Therefore, a customer booking a cruise for a specific date cannot use the seven-day withdrawal period to cancel. If a customer attempts to block payment, the service provider may take legal action, as they can prove the customer’s commitment and the resulting receivable.

Article 8 – Payment

The buyer must pay the full price of the cruise by credit card at the time of accepting Croisières Canada Ltée offer (see Article 6). Croisières Canada Ltée accepts the following cards: national credit cards, VISA, EUROCARD, and American Express, issued by national or foreign banks. The buyer guarantees to Croisières Canada Ltée, at the time of order validation, that they are in good standing with the card issuer. By providing their credit card information and confirming the order, the buyer accepts full payment for their reservation. Failure to pay, whether the total price, a deposit, or the balance, will result in order cancellation, and all customer-initiated cancellation terms (including fees) will apply. Some discounted flights must be issued on the day of booking, and a partial or full payment may be required immediately. For bookings more than 60 days before departure, a 30% deposit is due at booking, with the balance payable 2 months before departure, except for the following: Aranui, MSC, Costa Cruises, Croisières de France, NCL, Royal Caribbean, Azamara, Celebrity Cruises, Croisieurope, TAAJ Cruises, and all train travel bookings. COSTA Basic and Flash fares: 50% deposit at booking, balance 71 days before departure. Last-minute fares: full payment required at booking. Cunard promotions: 35% deposit at booking, balance 91 days before departure. For the following companies: Star Clippers, Princess, Carnival, Cruise’n Fly, Holland America, Seabourn, Anakonda Amazon Cruises, bookings must be fully paid 91 days before departure. World cruises: full payment 4 months before departure. Regent Seven Seas cruises: full payment 5 months before departure. Gauguin Cruises, Silversea, and Ponant: full payment 4 months before departure. Oceania cruises: less than 15 days: full payment 100 days before departure; 15 days or more: full payment 160 days before departure.

Article 9 – Travel Documents and Formalities

For all cruises and train trips presented in Croisières Canada Ltée electronic catalog and governed by these terms of sale, the buyer must hold one or more of the following valid documents as required: passport, national ID card, parental authorization, visa, medical certificate, vaccination record, etc. The formalities listed in Croisières Canada Ltée catalog are provided for Canadian citizens and are for informational purposes only. Passengers are responsible for checking the official Canadian government travel site for requirements by destination: https://travel.gc.ca/travelling/advisories The completion of travel formalities is the responsibility of the buyer, who must ensure that all requirements are up to date before departure. Any costs incurred to verify compliance are the responsibility of the buyer. The purchased cruise is non-refundable if the buyer is unable to depart on the scheduled date due to failure to present valid documents (passport, visa, etc.). In this case, any cancellation fees or related costs are the responsibility of the buyer. For the return flight, it is mandatory for the buyer to reconfirm their flight locally at least 72 hours before the return date. 1. Health Requirements It is the responsibility of the traveler to review all health conditions and formalities necessary for the proper execution of the trip. Travelers should stay updated on health information via: https://voyage.gc.ca/ 2. Pregnant Passengers “Onboard ships, medical facilities are not equipped for childbirth. Therefore, cruise lines cannot accept bookings or transport passengers who are 24 weeks pregnant or more at the end of the cruise. Any passenger who becomes pregnant after booking must inform our service team as soon as possible so appropriate measures can be taken. Otherwise, our company assumes no responsibility. Passengers must be able to demonstrate that they are less than 24 weeks pregnant to board.

Article 10 – Carrier Responsibilities

The ship operator reserves the right to assign passengers to a different cabin than originally booked, provided it is of the same or higher category. For “guaranteed cabin” bookings, the operator guarantees the availability and price of the cabin. The specific cabin assignment will be communicated at embarkation, as the cabin may not be physically available at the time of booking. In such cases, the operator may assign cabins with separate beds, bunk beds, cabins for reduced mobility passengers, obstructed views, or make cabin changes during the cruise. Guaranteed Quadruple Cabin: The operator may assign two double cabins to passengers. Croisières Canada Ltée cannot assume the responsibility of the transport providers (French or foreign) responsible for transfers or transport of passengers and luggage. Croisières Canada Ltée is not liable for flight schedules, changes in dates, routes, carriers, aircraft, number or choice of connections, or airport changes. In case of airport changes in Canada or abroad, shuttle, taxi, or bus costs are the responsibility of the buyer. The schedules and information in Croisières Canada Ltée electronic catalog are provided for guidance only. The liability of airlines or other carriers participating in Croisières Canada Ltée cruises or train trips, including their representatives, agents, or employees, is limited to the terms of the relevant transport contracts, for passengers and baggage only, in the event of damage, complaints, or claims. Croisières Canada Ltée draws the buyer’s attention to circumstances that may limit its responsibility in organizing cruises and train trips, including: Air transport constraints due to airspace congestion, aviation regulations, aircraft processing delays at airports, and safety requirements. Therefore, any traffic irregularities or delays cannot engage Croisières Canada Ltée’s liability.

Article 10 bis – Accommodation Onboard or in Hotels

For “guaranteed cabin” bookings, passengers may be reassigned to a different cabin during the cruise. They will be accommodated in a cabin of the same or higher category, though the cabin location may differ. For triple or quadruple guaranteed cabins, due to the limited number of such cabins, passengers may be assigned two cabins.

For departures from the USA, at least one person per cabin must be 21 years of age or older, in accordance with the legal age of majority applicable in the United States.

Article 11 – Organizer Responsibilities

For each service, when reference is made to the specific terms and conditions of the technical organizer, only those terms apply. All organizers of cruises and train trips offered in Croisières Canada Ltée electronic catalog and governed by these terms are covered by liability insurance in accordance with applicable laws and comply with regulations set by the authorities. Any delays in arrival for cruises or train trips must be reported to the cruise manager. If not reported, the local representative of the technical organizer may take responsibility for the service, and the buyer assumes sole responsibility. Ship operators reserve the right to cancel a cruise if the minimum number of participants is not reached. In this case, the client may accept a substitute cruise or request a refund of payments made, but cannot claim any additional compensation. In the event of a crisis (strike, riots, conflict, attack, health emergency, severe weather) or for any technical reason, the cruise line may, at any time and without prior notice: Cancel, advance, or delay a departure or stopover Change the ship or port of call The cruise line cannot be held responsible for cancellations, schedule changes, delays, or substitutions. Regarding schedules, itineraries, changes, registration, and cancellation conditions, the buyer is advised to refer to the details provided for each cruise in Croisières Canada Ltée electronic catalog. Some information may be provided subject to weather conditions or external events beyond the provider’s control, which may affect specific activities. Departures during holiday periods may involve special cancellation conditions, deposit requirements, or cruise duration restrictions. These details are specified for each trip or stay in Croisières Canada Ltée electronic catalog.

Article 12 – Complaints

All cancellation requests must be made via registered mail. The effective date is the date the buyer’s letter is received by Croisières Canada Ltée. For complaints related to the execution or organization of a trip, the buyer must submit them in writing within 8 days of the end of the trip to CRUISELINE - Croisières Canada Ltée. Complaints must be sent by registered mail with acknowledgment of receipt. Any complaints submitted after this period will be rejected. In case of difficulties during the cruise (flights, additional fees requested by a local provider, delays, etc.), Croisières Canada Ltée requests that the buyer document the facts in writing with the local authorities or the local representative of the organizer. Article 13 – Failure to Check In

In general, boarding begins four hours before departure. It is very important that you arrive at the boarding gate at least two hours before departure, as the gangway will be removed 90 minutes prior to departure. For late departures after 8:00 p.m., boarding may close earlier. Please verify the boarding time with your booking agent.  Croisières Canada Ltée cannot be held responsible if the buyer fails to check in at the departure point for a package air trip, regardless of the reason, including delays in connecting air, rail, or ground transportation, even if such delays are caused by force majeure, unforeseeable events, or third parties. Article 14 – Insurance

Croisières Canada Ltée has contracted with RC PRO chez Intact Insurance Company for professional liability insurance, with coverage of 1 620 840 $CAD . For the safety and protection of travelers,  Croisières Canada Ltée recommends that clients purchase additional insurance at the time of booking, including coverage for: Repatriation Trip cancellation Trip interruption Baggage

Article 15 – Personal Information

Unless the buyer expressly objects, they consent to the use of personal data collected during the cruise booking for Croisières Canada Ltée’s customer database. In accordance with French law No. 78-17 of January 6, 1978 on data processing, files, and individual liberties, the buyer has the right to access and correct their personal information at any time. Regarding information provided for payment by credit card, Croisières Canada Ltée guarantees that such data is not retained by Croisières Canada Ltée or its agencies after payment has been processed.

Article 16 – Applicable Law

This contract is governed by Quebec law.

Article 17 – Dispute Resolution

In case of a dispute, the buyer should first contact the seller to try to reach an amicable solution.  Croisières Canada Ltée’s failure to enforce any of the buyer’s obligations under these terms of sale cannot be interpreted as a waiver of that obligation in the future, nor does it limit the buyer’s right to later assert any breach.

Article 18 – Changes to Itineraries and Schedules

We cannot guarantee that the ship will call at every scheduled port or follow the published itinerary. Certain external circumstances (e.g., weather conditions, strikes, riots) may require the Captain, for the safety of passengers, to: Cancel or shorten a port of call Add additional stops Modify the itinerary, Change the ship or port Canada Ltée cannot be held responsible for such changes or for any failure to meet the arrival or departure times indicated in the brochure, regardless of the port of call.

Article 19 – Force Majeure

Croisières Canada Ltée cannot be held liable in cases of force majeure. Force majeure refers to any external event beyond the control of the parties, both unpredictable and insurmountable, which prevents either the travelers, the agency, or the service providers involved in the trip from fulfilling all or part of the obligations under the contract. Croisières Canada Ltée assumes no responsibility if the services promised for your cruise or train trip cannot be provided or performed under the conditions agreed upon due to circumstances beyond our control, even when all reasonable precautions have been taken. Examples of such events include, but are not limited to: Wars or threats of war Acts of terrorism or threats thereof Riots or civil unrest Strikes Natural or nuclear disasters Fires Severe weather conditions Epidemic risks Mechanical failures (not foreseeable despite technical checks) Any other events outside our control

Annexes – Article 95

Subject to the exclusions set out in the second paragraph (a) and (b) of Article 14 of the law of July 13, 1992, every offer and sale of travel or holiday services must be accompanied by appropriate documentation that complies with the rules defined in this title. In the case of the sale of transport tickets not combined with related services, the seller must provide the buyer with one or more travel tickets covering the entire journey, issued by the carrier or under its responsibility. For on-demand transportation, the name and address of the carrier on whose behalf the tickets are issued must be clearly indicated. A separate invoice for the various components of the same travel package does not exempt the seller from the obligations set out in this title. Article 96 Before concluding the contract and in writing, stating its corporate name, address, and the details of its administrative authorization to operate, the seller must provide the consumer with information on prices, dates, and other elements of the services provided during the trip or holiday, including: The destination, means, characteristics, and categories of transportation used The type of accommodation, its location, comfort level, main features, official approval, and tourism classification according to local regulations or standards Meals provided A description of the itinerary for guided tours or circuits Administrative and health formalities, including border crossing requirements and timeframes Included or optional excursions, visits, and other services, including additional costs if applicable Minimum or maximum group size required for the trip or holiday, and if the trip depends on a minimum number of participants, the deadline for notifying the consumer in case of cancellation (not less than 21 days before departure) The amount or percentage of the deposit required when signing the contract and the schedule for paying the balance The price revision terms as provided under the contract in accordance with Article 100 of the relevant decree Contractual cancellation conditions Cancellation terms defined in Articles 101, 102, and 103 below Details of risks covered and the amount of coverage under professional liability insurance for travel agencies, as well as liability coverage for nonprofit organizations and tourism bodies Information on optional insurance or assistance contracts covering specific risks, including repatriation in the event of accident or illness Article 97 The pre-contractual information provided to the consumer binds the seller, unless the seller has explicitly reserved the right to modify certain elements. If modifications are allowed, the seller must clearly indicate the scope of such changes and which elements may be affected. Any changes to pre-contractual information must be communicated in writing to the consumer before the contract is concluded. Article 98 The buyer may transfer their contract to another person who meets the same conditions to take the trip or holiday, as long as the contract has not yet taken effect. Unless otherwise stated in the buyer’s favor, the original buyer must inform the seller by registered mail with acknowledgment of receipt at least fifteen days before the trip starts. This transfer does not require prior authorization from the seller under any circumstances. Article 99 When the contract explicitly allows for a price revision, within the limits set out in Article 19 of the Law of July 13, 1992, it must specify the exact calculation method for any increase or decrease in price, including: The amount of transportation costs and related taxes The currency or currencies that may affect the price of the trip or holiday The portion of the price to which the revision applies The exchange rate(s) used as a reference when determining the price stated in the contract Article 100 If, before the buyer’s departure, the seller must make a modification to an essential element of the contract (such as a significant price increase), the buyer may, without prejudice to any claims for damages: Cancel the contract and receive an immediate refund of all amounts paid, without penalty; or Accept the modification or an alternative trip proposed by the seller. In the latter case, an addendum to the contract detailing the modifications must be signed by both parties. Any price decrease will be deducted from any remaining amount owed by the buyer, and if the buyer has already paid more than the adjusted price, the overpayment will be refunded before the departure date. Article 102 If, after the buyer’s departure, the seller is unable to provide a substantial part of the services included in the contract, representing a significant percentage of the price paid by the buyer, the seller must immediately take the following measures, without prejudice to claims for damages: Offer replacement services, covering any additional costs. If the replacement services are of lower quality, the seller must refund the price difference to the buyer upon their return; or If no suitable replacement services can be offered, or if the buyer validly refuses the alternatives, the seller must provide the buyer with transportation tickets at no additional cost to return either to the departure location or another mutually agreed location. Article 103 The provisions of Articles 95 to 103 of this decree must be included in the brochures and travel contracts offered by the entities referred to in Article 1 of the Law of July 13, 1992.
